TERMS OF SERVICE & CO-RESPONSIBILITY AGREEMENT


By engaging in business, accepting quotes, or interacting with Gráfica AM, the client explicitly agrees to this Co-Responsibility and Contractual Framework:


1. DESIGN CREATION & CONDITIONAL COURTESY

Design and artwork services provided by Gráfica AM are offered as a courtesy strictly bundled with the successful completion and manufacturing of the respective order. If an order is canceled or abandoned after design development has initiated, the client remains liable for design fees, setup costs, and intellectual work performed. All editable, source, or vector files remain the exclusive property of Gráfica AM unless a formal licensing fee is purchased.


2. CONTRACTUAL PREVALENCE & FORMAL AGREEMENT

The terms outlined on this platform serve as general operational guidelines. Specific terms, retention fees, cancellation penalties, manufacturing specifications, and payment terms are governed by the formal written agreement (Sales Contract/Invoice) sent via official email. Email acceptance, tacit confirmation, or invoice payment constitutes binding assent to all terms within the contract and this framework.


3. FOUR-STAGE CONSULTATIVE & APPROVAL PROTOCOL

Our production process operates under a mandatory multi-stage confirmation protocol requiring client responsiveness:


• Stage 1: Contract & Payment Confirmation

Confirmation of payment and email response constitutes formal acceptance of order details, pricing, quantities, and contractual clauses.


• Stage 2: Artwork Proof & Typographical Responsibility

Clients are strictly obligated to thoroughly inspect all digital proofs for spelling, layout, design elements, and dimensions prior to issuing final approval. Regardless of initial inputs or operator drafting, the client’s final approval ("OK") transfers full legal responsibility for accuracy to the client. Gráfica AM is not liable for errors present in approved artwork.


• Stage 3: Post-Production Visual Inspection

Upon completion, high-resolution photographs/videos of the finished goods are provided. The client must review and confirm that items meet visual expectations. Approval or lack of timely objection during this stage confirms that visual verification was adequate and products are approved for international dispatch.


• Stage 4: Tracking, Delivery & Shared Logistics

While Gráfica AM provides tracking codes and monitoring assistance as a courtesy, tracking and delivery monitoring are the client's sole responsibility.

  • Delivery Attempts: The client is fully responsible for ensuring an authorized recipient is present during all delivery attempts by international carriers.

  • Local Collection: If package delivery fails due to absence, incorrect address, or carrier hold, the client is strictly responsible for contacting or visiting the local carrier hub/customs facility in a timely manner. Gráfica AM is not responsible for returned or abandoned shipments resulting from client inaction.

  • Customs Clearance & Tariffs: The client is strictly responsible for all local import tariffs, customs duties, and nominal clearance processing fees levied by destination authorities (US/CA). Timely settlement of these charges is required for package release, and Gráfica AM is not liable for delays, holds, or abandoned shipments caused by unpaid destination fees.

  • Multi-Box Dispatch Protocol: To maintain peak transit speed and ensure eligibility for streamlined postal entry, orders are structured from inception into parcels under $800 USD. Multi-box dispatch strategies are pre-communicated whenever applicable to guarantee smooth, direct-to-door delivery.
